Terms & Conditions

1. Overview

(a) The Uber Reserve Heroes Sponsorship Search (Sponsorship Search) is conducted by Uber Australia Pty Ltd (ABN 49 160 299 865) (Uber, we, us or our).

(b) By entering the Sponsorship Search, all entrants (you or your) agree to be bound by these terms and conditions (Terms) and our Privacy Notice at https://www.uber.com/legal/en/document/?name=privacy-notice&country=australia&lang=en-au. Any breach of these Terms or our privacy policy may result in disqualification.

(c) To the extent of any inconsistency between these Terms and any other reference to the Sponsorship Search, these Terms prevail.

(d) The Sponsorship Search:

  1. begins at 12 am Australian Eastern Daylight Time (AEDT) on March 11th 2024; and
  2. ends at 11:59 pm Australian Eastern Standard Time (AEST) on March 31st 2024,

2. Eligibility

(a) This Sponsorship Search is open to Eligible Teams.

(b) An Eligible Team is any reserve or non-professional (that is not paid to play) local or community sports team or club in Australia whose members are aged 18 or over at the time of entry including, but not limited to, a local or reserve sporting team, club side, or social team from male, female, or mixed competition (Eligible Team).

(c) Employees and contractors (and their Immediate Families) of Uber Australia Pty Ltd, our Related Bodies Corporate and the agencies associated with this Sponsorship Search are ineligible to participate.

3. How to enter

(a) To enter the Sponsorship Search, you must, during the Entry Period, submit a video of a length of up to 60 seconds, which addresses the following questions:

  1. What is the name and location of the Eligible Team?
  2. What makes the Eligible Team the most deserving of the Sponsorship?
  3. How would the Eligible Team spend the Sponsorship?

(b) We will not accept entries submitted after the end of the Entry Period.

(c) The time of each entry will be the time and date we received the entry, according to our internal servers.

(d) Each entry must be submitted on behalf of an Eligible Team. Each Eligible Team can submit 1 entry only.

(e) We may, at any time:

  1. verify the validity of entries and entrants (including your identity, age and place of residence); and
  2. disqualify any entrant or entry that does not comply with these Terms or who otherwise tampers or interferes with the entry process.

(f) Incomplete or illegible entries will be invalid at our discretion.

(g) We are not responsible for incorrect, incomplete, late or misdirected entries.

(h) If there is a dispute as to your identity or details, we reserve the right to determine your identity or details and our determination is final.

4. Determination

(a) On April 1st 2024, the entries will be reviewed by a judging panel (Judging Panel) at our office at Level 30, 580 George Street, Sydney, New South Wales, 2000.

(b) The Judging Panel will:

  1. judge the entries of Eligible Teams based on:
    1. whether the entry adequately addresses all requirements set out in clause 3(a);
    2. the merit of the entry, having regard to factors such as the Eligible Team’s team camaraderie and ability to overcome hardship; and
    3. any other factors the Judging Panel reasonably considers relevant to its determination; and
  2. shortlist three entries and, of the shortlisted entries, one Eligible Team will be selected to receive the Sponsorship based on a vote by the members of the Judging Panel and Uber’s brand representative(s).

(c) We may select additional valid entries and record them in case:

  1. an invalid entry or ineligible team is selected; and
  2. we elect to use the reserve entries.

5. Outcome

(a) The winning Eligible Team will be notified within 7 days of the end of the determination by email and/or phone call.

(b) It is your responsibility to notify us in writing if your contact details change.

(c) The names of the winning Eligible Team and its members may be published on our websites and social media pages, and in any other promotional material that we consider relevant. By entering the Sponsorship Search, you consent to us publishing your details.

(d) Our determination is final.

6. Sponsorship

(a) The winning Eligible Team will be offered a sponsorship valued at $50,000 (inclusive of any GST) (Sponsorship).

(b) The provision of the Sponsorship is conditional on the winning Eligible Team entering a sponsorship agreement on terms acceptable to Uber.

(c) We are not liable for any additional, incidental, or related costs in connection with the entering the Sponsorship Search or winning the Sponsorship.

(d) The Sponsorship must be claimed in accordance with our instructions provided within 48 hours of the winner being notified.

(e) If the winning team fails to claim the Sponsorship within the period specified in clause 6(d), or the parties fail to enter into a sponsorship agreement for the provision of the Sponsorship within a reasonable period, we may elect to offer the Sponsorship to the next eligible reserve entry.

(f) The Sponsorship is not transferable, saleable or redeemable as cash, credit or equivalent.

(g) You should seek independent advice, including financial advice, as implications (such as tax) may arise as a result of winning the Sponsorship.

7. Entries

(a)By entering this Sponsorship Search, you grant us a non-transferable, sublicensable, royalty free, irrevocable licence to use, edit and publish your entry and Eligible Team information for our promotional purposes.

(b) You are responsible for the entry you submit, including its content (such as text, images, photos and videos) and any accompanying comments.

(c) We are not liable in any way for your entry, to the fullest extent permitted by law.

(d) You warrant and agree that:

  1. you will not submit any entry that is unlawful or fraudulent, or that we could reasonably consider to be in breach of any Intellectual Property Rights, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; 
  2. you will obtain prior written consent from any person that is reasonably identifiable in your entry before submitting it;
  3. you will obtain prior written consent from any person who has jointly created, or has rights in, your entry, to these Terms and our privacy policy; 
  4. you have obtained all necessary consents to grant the licence in clause 7(a), including any such consents required from commercial sponsors or Eligible Team management for us to use, edit and publish your entry in any media or channel for promotional purposes without payment to you. 
  5. your entry does not contain viruses and will not cause injury or harm to any person or entity; and 
  6. you will comply with all applicable laws and regulations, including those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

8. Personal information

(a) By entering the Sponsorship Search, you consent to us:

  1. using your Personal Information to conduct the Sponsorship Search;
  2. communicating with you about the Sponsorship Search, including contacting you about the outcome of the determination and providing the Sponsorship if you are part of the winning team; and
  3. to the extent your entry contains any Personal Information, using that Personal Information for promotional purposes in accordance with the licence granted in clause 7(a).

(b) We may disclose your Personal Information to our Related Bodies Corporate, agents and service providers for the purposes described above.

(c) You warrant that if your entry contains, or you otherwise provide us with Personal Information of another individual, you have notified them of the matters in this clause and obtained their consent.

(d) If you (or any person whose Personal Information you provide to us) do not consent to the collection of that Personal Information for the purposes described above, you must not enter the Sponsorship Search.

  1. how you may access, correct or delete your Personal Information; and
  2. how you may make, and how we will handle, a privacy complaint.

9. Liability

(a) Nothing in these Terms excludes, restricts or modifies any rights or remedies under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified.

(b) Subject to clause 10(a) and to the fullest extent permitted by law, we and our Related Bodies Corporate (and each of their officers, directors, employees, contractors and agents):

  1. are not responsible for any error, omission, interruption, delay in operation or transmission, communications line failure or any other event beyond our control. In these circumstances, if we elect to cancel or postpone the Sponsorship Search, we do so without liability and may reschedule it on the same terms;
  2. make no express or implied warranties, representations or guarantees, in fact or in law, regarding the Sponsorship Search or the merchantability, quality or fitness for purpose of any part of the prizes; and
  3. exclude all liability (including for negligence) for any personal injury or loss or damage (including for loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Sponsorship Search, including where arising out of:
    1. any technical difficulties or equipment malfunction (whether or not under our control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that fails to be transmitted or is cancelled, delayed, deleted, interrupted or late (whether or not after our receipt or otherwise);
    4. any variation in prize value or specification;
    5. any tax liability or similar charge incurred by a winner; or
    6. use of a prize by a winner.

(c) We are not responsible for any problem or technical malfunction of any telephone network or lines, computer systems, servers, providers or equipment, software, traffic congestion on the internet or any website, or any combination of those, including any injury or damage to entrants or any other person’s computer related to or resulting from participating in the Sponsorship Search.

(d) You are solely responsible for any costs associated with entering the Sponsorship Search, noting these costs may depend on the internet service provider you use.

(e) Without limiting any other terms, you indemnify us and our Related Bodies Corporate (and their officers, directors, employees, contractors and agents) from and against your breach of these Terms.

10. Disruption to Sponsorship Search

a) If, for any reason, the Sponsorship Search is affected or interfered with in any way or is not capable of being conducted as planned due to a Force Majeure Event, including where such circumstance corrupts or affects the administration, security, fairness or integrity or proper conduct of the Sponsorship Search, we may, to the fullest extent permitted by law:

  1. disqualify any entrant who tampers or interferes with the entry process; or
  2. subject to required regulatory approval, cancel, terminate, modify, reschedule or suspend the Sponsorship Search, as appropriate.

(b) Any entrant found to be tampering or interfering with the entry process will have all entries invalidated and any claim to a prize will be invalidated. We will determine whether a breach has occurred at our discretion and may request any documentation.

11. General

(a) Any failure to enforce our rights does not constitute a waiver of those rights.

(b) To the extent permitted by law, the Sponsorship Search may be withdrawn or cancelled at any time in our discretion.

(c) Any part of these Terms that is illegal, void or unenforceable may be severed, and the remainder will continue in force.

(d) Unless otherwise stated, the plural includes the singular (and vice-versa).

(e) The Sponsorship Search and any issues relating to the construction, validity, interpretation and enforceability of these Terms will be governed by the laws of New South Wales, Australia.

12. Definitions

(a) Force Majeure Event means an event or circumstance beyond our reasonable control, including natural disaster, acts of war, riots, vandalism, failure or shortage of power supplies or other essential utility, pandemic, epidemic, quarantine or other widespread or serious threat to human health (including an outbreak or recurrence), strike, a change in applicable law or platform rules, government imposed shutdown or closure, infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures, down time or issues.

(b) Immediate Families means any of the following (whether natural, step or adopted): spouse, ex-spouse, de-facto spouse, child, parent, grandparent, uncle, aunt, niece, nephew or sibling.

(c) Intellectual Property Rights means all patents, rights to inventions, copyright, trade marks, trade names and domain names, rights in goodwill, rights in confidential information and any other intellectual property rights, whether registered or unregistered and including all applications for, and renewals or extensions of, such rights and all similar rights which subsist now or in future anywhere in the world.

(d) Personal Information has the meaning in the Privacy Act 1988 (Cth).

(e) Related Bodies Corporate has the meaning in the Corporations Act 2001 (Cth).

**As noted in the Terms and Conditions, you grant us a licence to use your entry video for promotional purposes, including to promote the Sponsorship Search and our business.
